Terms & Conditions

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to Australian residents aged 18 years or over only. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. The promotion commences 3pm, AEDST 31 March, 2008, and closes at 11:59pm , AEST 7 May, 2008. Enter by registering your details into the voting and promotion entry form on the website www.gourmettraveller.com.au/travel_awards. Entrants are able to vote from each category, although the entrant does not need to vote for every category to be eligible to enter the competition. Entrants must also answer, in 25 words or less what their favourite international holiday destination or hotel is, and why. All include your name, address and telephone contact details as prompted.

5. For the removal of doubt, an invalid entry consisting of a valid vote, may still be included for research purposes and inclusion in the voting tally only.

6. Participants must fill out, in full, all mandatory elements of the voting and promotion entry form in order for their vote / entry to be valid. Incomplete, indecipherable, inaudible or illegible entries will be deemed invalid.

7. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) each entry must be substantially unique.

8. Only entries completed via the online entry form will be accepted as valid. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit. The judges’ decision is final and no correspondence will be entered into.

9. The promotion will be judged by a panel appointed by the Promoter. The promotion will be judged at the promoters premises. Judging will begin  at 11am AEST on the  8 May, 2008. The winner will be notified by mail using contact details provided in their entry and their name will be published in The Australian on Monday, 26 May, 2008.

10. The best valid entry as determined by the judges will be deemed the Major prize winner and will be awarded the major prize valued at $18,129.36. This major prize includes two return British Airways World Traveller Plus (premier economy class) tickets from either Sydney, Melbourne or Brisbane to Paris (valued at $13,295.36); eight nights' shared accommodation at three hotels from Small Luxury Hotels of the World's Paris collection including 3 nights at L'Hôtel, including daily buffet breakfast for two during the stay and one lunch for two, including drinks (Tuesday to Friday lunch), plus 5 nights' accommodation at two other central Small Luxury Hotels of the World hotels in Paris. The winner will be able to select the accommodation they wish to stay at from a choice of over 40 properties throughout the Small Luxury Hotels of the World portfolio within France. Selection of accommocation venue is  subject to booking and availability and time of redemption of travel prize. It is a condition of accepting the prize that the winner agree to to be bound by the normal business guidelines and standard terms and conditions of each accommodation venue they stay at. Accommodation  component of the prize is valued at  up to $4,834 (depending on choice of hotel and rates at the time of redemption of the prize). Prize also includes a visit to the Nespresso flagship Boutique in Paris and a bonus Nespresso gift to the value of $200.  Products included in prize (including but not limited to brands, colours and models of items) is determined at the complete discretion of the Promoter. Prize must be redeemed in full  between 7 May, 2008 and 31 March, 2009 and is subject to booking and flight availability. Prize may not be redeemed during hotel blackout dates see point 12 below.

11. The next 5 best  entries as determined by the judges will be deemed the First Runner Up prize winners and  will be awarded a Nespresso Silver Le Cube Coffee Machine, valued at RRP$449 each. The next 5 best entries as determined by the judges will be deemed 2nd Runners Up and will be awarded a Nespresso Red Le Cube Coffee Machine, valued at RRP$399 each. Items awarded as Runners Up prizes (including but not limited to colours and designs) are determined at the complete discretion of the Promoter. Prizes do not include any ancillary costs associated with redeeming their prize. These are the responsibility of the winner.

12. The British Airways flights include all Government surcharges, fees and taxes as at 3 March 2008. Travel from Melbourne / Brisbane to Paris is via Sydney connecting onto a British Airways operated flight. Travel from Melbourne / Brisbane to Sydney is operated by Qantas Airways in economy class. Travel from London to Paris will be in Euro Traveller (economy class) on British Airways.

13. Hotel accommodation can not be booked during the following dates: 27 June, 2008 through to 1 July, 2008; 25 July, 2008 through to 25 August, 2008; 27 September, 2008 through 5 October, 2008;  19 December, 2008 through to  2 January, 2009; 5 March, 2009 through to 12 March, 2009.

14. The winner (and companion) of the Paris holiday is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner (and any companion) must depart from and return to the same departure point and travel together. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in. They will be carried pursuant to the British Airways’ General Conditions of Carriage (copy available on request). The prize does not include any ancillary costs; these are at the prize-winners own expense. Prize excludes: meals, visas, passport costs, travel insurance, spending and other transport costs. Any change in the value of the flights during the promotion is not the responsibility of the promoter. Travel insurance is not included in the prize, however is strongly recommended.

15. Total prize pool is valued at $22,369.36.

16. Prizes do not include ancillary costs associated with redeeming the prize. These are the responsibility of the winner. Where a portion of the prize is awarded to the winner in the form of a letter/voucher/ ticket/ pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the letter/voucher/ ticket/ pass. The Promoter will not be liable for any letter/ voucher/ ticket/ pass that has been lost, stolen, forged, damaged or tampered with in any way.

17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; and/or (f) redemption of a prize.

18. The prizes are not transferable or exchangeable and cannot be taken as cash. All entries become the property of the Promoter.

19. The collection, use and disclosure of personal information provided in connection with this competition are governed by the Privacy Notice.

20. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.

21. By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit (with their literary piece being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant.
